We’re bringing you the latest breaking news from the Diddy trial, where the jury has just sent a crucial note to the judge. After approximately 12 to 13 hours of deliberation, the jurors have informed the court they’ve reached unanimous verdicts on four of the five charges – counts 2, 3, 4, and 5 – but are completely deadlocked, or “hung,” on count one, the racketeering conspiracy charge.
The Racketeering Dilemma
Count one, the racketeering conspiracy, is the RICO charge, and while it’s been widely reported as the most serious, we’ve clarified that it’s not actually the most serious charge he faces in terms of potential sentencing. RICO carries a 10-year minimum to a life maximum sentence. However, counts two and four, which are for trafficking by force, fraud, or coercion (18 US Code 1591), carry an even higher minimum sentence of 15 years to life.
The jury’s inability to reach a consensus on the racketeering conspiracy is significant. As we understand it, to even consider the racketeering charge, Diddy needs to be found guilty of at least two of the other charges. The fact that the jury is deliberating on count one strongly implies that they have definitely found him guilty on at least one or two of these other charges. If they hadn’t found him guilty of any underlying crimes, there would be no reason to be questioning the RICO charges.
We believe it’s safe to say that Diddy is likely heading to prison, depending on which crime they’ve found him guilty of. At this point, he’s definitely not walking away with a “not guilty” verdict.
The Specific Charges and What We Know
The four charges on which verdicts have been reached – counts 2, 3, 4, and 5 – include:
- Count 2: Trafficking by force, fraud, or coercion.
- Count 3: Transportation to engage in prostitution.
- Count 4: Trafficking by force, fraud, or coercion (this is the same as count 2).
- Count 5: Transportation to engage in prostitution (this is the same as count 3).
These four charges relate specifically to two women: Cassie Ventura and another ex-girlfriend using the pseudonym Jane.
It’s important to note that if the jury only found him guilty on the prostitution charges and ignored the trafficking charges, that might be his only “out” from a longer sentence. However, the presence of the trafficking charges suggests a more severe outcome.
Jury’s Requests and Deliberation Dynamics
Earlier today, the jurors asked for more information on Cassie Ventura’s text messages, specifically a message where Cassie reportedly said, “Hey when can we do another freakoff?”. Our guess is that this request suggests they may have found him guilty concerning the other woman (Jane) but not Cassie Ventura.
After the jury initially stated they could not reach a verdict on count one, the judge ordered them back into deliberations to continue trying to reach a verdict. A tense-looking Diddy was surrounded by his lawyers, with his children and mother watching nearby during this exchange.
Shortly after, the jurors sent another note, confirming they would continue deliberating on Wednesday morning at 9:00 a.m. Eastern Time.
There was considerable back-and-forth between the prosecution and defense regarding how the judge should instruct the hung jury. The defense argued that the jurors have been very efficient and shouldn’t be pushed. Prosecutors, however, contended that simply telling them to go back without addressing their concern might lead to a repeat of the deadlock. The judge ultimately decided to instruct them to continue deliberating without directly addressing their concern about being “unpersuadable” on count one.
Holiday Weekend Pressure?
One significant point of discussion involves the approaching July 4th holiday weekend. We just learned from our producers inside the courthouse that the defense wants to ask the jury at the end of tomorrow (Wednesday) whether they would be willing to stay over July 3rd, rather than asking them today. Neither the defense nor the prosecution objects to a July 3rd meeting if it becomes necessary. The defense’s concern is that they don’t want jurors to feel rushed or stressed into a decision when faced with holiday plans. We believe it’s still too far out from the holiday for that concern to significantly impact their decision tomorrow, and they have all day to decide on this single charge. However, if the jury was leaning towards conviction, a push back into deliberations before a holiday could indeed pressure them to convict.
What’s Next?
The only question now appears to be whether Diddy faces a life sentence or a shorter term; that’s how we see it. We feel that they wouldn’t be deliberating on charge one unless they were at least charging him with one of the other counts.
